Rödl & Partner regularly consults clients on whistleblowing-related issues. We offer whistleblowing advisory services as part of an all-inclusive compliance advisory and corporate liability package that reflects the most recent statutory regulations on the internal reporting of any breach of law and on the protection of whistleblowers (compulsory whistleblowing).       

A proper whistleblowing system is a combination of two primary systems, namely a whistleblowing management system, which facilitates secure channels for receiving, assessing and addressing any reports on illegal or unethical conduct within a business corporation, and a system based off of adequate precautions that allow for the effective protection of whistleblowers against any potential retaliation.  

We offer help and assistance in introducing and improving the whistleblowing management system. It may function either as one of the key elements of a comprehensive compliance management system (CMS) or as a standalone system implemented in order to satisfy client duties under Directive (EU) 2019/1937 and under the Whistleblower Protection Act. 

As corporate compliance experts, we keep our clients safe and sound as under our guidance they are able to meet the whistleblowing requirements arising from international ISO standards, especially ISO 37301 and ISO 37002, and under new statutory regulations. General compliance is then most efficient and can be effected in an organic manner, which is a task that is virtually impossible to keep up with without the help and advice from an experienced and highly qualified advisor. 

Our whistleblowing advisory services are not limited to the in-depth legal consulting required to ensure compliance. We can also help set up a whistleblowing system that will deter wrongdoing and ethical misconduct, while minimising corporate liability risks.   

We cooperate closely with the providers of state-of-the-art anonymous reporting systems. One such provider is FaceUp Technology s.r.o.. It runs an integrated NNTB platform that satisfies all statutory and technological requirements, while providing a wide variety of means how to collect, assess and address whistleblowing reports. 

Thus, together with our contract partners, we offer clients an integral package that combines legal and other associated advisory with an advanced whistleblowing management platform. 

Our services in the field of whistleblowing management and compliance include:      
  • The design and implementation of bespoke whistleblowing solutions tailored to our clients’ needs and capabilities;
  • The preparation and implementation of a whistleblowing management system, including all relevant documents, and communication support for client employees and other potential whistleblowers (interns, contractors, etc.);
  • Advisory and support to ensure compliance with data processing and whistleblower protection requirements (under the GDPR) arising in connection with the whistleblowing management system; 
  • Other on-site advisory and legal services related to the implementation of the whistleblowing system and associated support processes (internal training and communication, etc.);
  • Off-site management of the client’s whistleblowing system by Rödl & Partner, including the designation and appointment of the officer responsible for handling reports and keeping whistleblowing records;
  • Independent advisory and support in reviewing anonymous reports and drafting opinion letters and recommendations that address the issues raised in such reports.
