Litigation forms a standard component of the legal services provided by Rödl & Partner.  Dispute advisory includes analyzing and predicting the likely outcome of a dispute based on the information provided. Such advisory also includes client representation during negotiations on an amicable resolution, as well as representation before all courts and in arbitration proceedings. 

Our aim is to find a solution that suits our clients not only from a legal perspective but also from a business perspective. We are well aware that our clients may wish to avoid prolonged proceedings before the courts. Therefore, when drafting commercial contracts and securing our client’s contractual receivables, we focus on the prevention of any potential disputes. In adversarial proceedings, we first discuss the options with our clients and then, together, we proceed to select the best procedural strategy. If necessary, we guide our clients in their search for suitable evidence with the help and support of experts and their expert opinions.

A specific area of procedural law consists of representing clients in administrative proceedings, typically tax proceedings, and the subsequent proceedings before administrative courts. In addition to tax proceedings, this also includes representing clients in cases involving construction law, customs law and environmental law.

When it comes to litigation, we can also assist our clients with the routine collection of receivables. The Evolio system that we use for such activities makes it possible to standardize this procedure and to provide clients with regular reporting.

Another special area of litigation consists of cases where we represent medical facilities during disputes with patients.
