Competition law

We provide comprehensive legal services in all matters pertaining to competition. Advisory covers cartel competition law (agreements between undertakings) and the abuse of dominant positions, regulations on concentrations between undertakings, state aid, and the specific area referred to as the private enforcement of competition law.

An integral part of our advisory in this area consists of services associated with competition compliance (Antitrust & Competition Compliance) and the representation of clients in disputes involving unfair competition.

We offer the following legal services:

Analysis and design of suitable methods for introducing internal procedures that ensure compliance with economic competition regulations, including the introduction of suitable methods for internal and external communication
Implementation of the requirements stipulated by the Act on the Protection of Economic Competition and other legal regulations into a company’s internal processes
Identification and analysis of the main competition-related risks, taking into account the company’s business activity, market position, size and other criteria
Comprehensive and specialised audits that act as an external check of compliance with competition rules
Analysis and assessment of competition-related risks during the conclusion of contracts and M&A transactions (M&A and Contract Assessment), particularly the risks associated with the prohibition of certain agreements between undertakings and the prohibition of abuse of dominant position
Representing clients before the Office for the Protection of Competition and before administrative courts, if a subsequent motion is filed against the Office’s decision
Representing clients in court proceedings involving the private enforcement of competition law or unfair competition
In-house training for corporate employees regarding competition rules and competition compliance

Our competition law and competition compliance advisory is aimed at ensuring that our client meets the requirements and individual obligations of undertakings with regard to economic competition under current legal regulations. We also focus on helping our clients avoid risks such as potential fines for a breach of competition rules. Such fines may amount to as much as CZK 10,000,000 or 10% of the net turnover generated by the relevant undertaking during the most recent, completed fiscal year.
